Terms of Service

These terms govern your use of PaceTracker, a self-documentation tool for Continuing Professional Development (CPD) records under the APEGA PACE framework. By creating an account or using the service you agree to these terms. PaceTracker is operated by Pace Tracker, 903 8 Ave SW, Calgary, Alberta T2P 0P7, Canada (Business Number 753473438 · GST 753473438RT0001) (“we”, “us”).
1. The service
PaceTracker lets you build and sign a PACE plan, record CPD activities with written explanations, attach evidence to activities and module records, track myAPEGA learning module dates, export an audit pack (PDF) of your records, and download a complete export of your data. The dashboard may also suggest third-party courses relevant to gaps in your own records (see section 5). The service is under active development: features may change, and occasional interruptions are possible.
2. Independence from APEGA
PaceTracker is an independent tool. It is not affiliated with, endorsed by, or connected to APEGA (the Association of Professional Engineers and Geoscientists of Alberta). References to APEGA, PACE, and myAPEGA are used only to describe compatibility with that regulatory framework. Mandatory learning modules are completed on myAPEGA only; PaceTracker records completion dates for your files.
3. No compliance guarantee
Your records in PaceTracker are self-documented. PaceTracker does not determine, certify, or guarantee your compliance with APEGA requirements, and the informational self-checks shown in the app and in exports are computed from your own records for your convenience only. Your CPD status with APEGA is determined solely by APEGA, and you remain solely responsible for meeting your professional obligations, including the accuracy and completeness of what you record.
4. Not professional advice
Nothing in the service constitutes legal, regulatory, or professional advice. Guidance text in the app summarizes public APEGA documentation; always refer to the official APEGA publications for authoritative requirements.
5. Suggested courses and third-party content
The dashboard may show courses offered by third parties that appear relevant to gaps in your own records. These suggestions are provided for convenience only: we do not endorse course providers or their content, we make no representation about course quality or suitability, and APEGA does not accredit or approve courses. A course counts toward your CPD only once you complete it and log and document it yourself as an activity. Some course links may in the future be sponsored or affiliate links; where that is the case they will be marked as such, and any such arrangement never changes which gaps or suggestions are shown to you. Your dealings with a course provider are solely between you and that provider.
6. Your account
You sign in with email links, so keeping access to your email inbox secure is your responsibility. You agree to provide accurate information and to use the service only for your own professional records.
7. Acceptable use
- No attempts to access other users’ data or to probe or disrupt the service.
- No unlawful, infringing, or malicious content in uploaded evidence.
- No automated scraping or resale of the service.
8. Your content
You own the records and files you store in PaceTracker. You grant us a limited licence to host and process them solely to operate the service for you (for example, to render your plan or generate your audit pack). We claim no other rights over your content.
9. Availability and backups
We aim for reliable operation but do not warrant uninterrupted availability. We recommend periodically downloading your audit packs and data export as your own backup of record.
10. Fees, cancellation and refunds
The service is free of charge until paid annual subscriptions are introduced; when they are, the following applies.
Price and renewal. The subscription price and applicable taxes are shown before you subscribe, together with the renewal date and these policies, and you are given an express opportunity to review your order, correct errors, and accept or decline before any charge is made. Subscriptions renew annually until cancelled; we email a renewal notice to your account address before each renewal date, and after each purchase or renewal we email you a confirmation with the terms of your subscription.
Cancellation. You can cancel at any time, self-serve, from the Account page. Cancellation takes effect at the end of the paid period already underway: you keep full access until that date and no further charges are made. Afterwards your account switches to read-only — your records stay readable and exportable.
Refunds. The first charge of your first subscription has a 14-day refund window: contact support within 14 days of the charge and we refund the full amount to your original payment method within 15 days. Other charges are non-refundable except where the law provides otherwise. Nothing in these terms limits any non-waivable rights you may have under the Consumer Protection Act (Alberta) and its Internet Sales Contract Regulation.
Early Bird offer. The first 30 accounts to complete onboarding are assigned an Early Bird seat, in order of completion; your seat number is shown on the Account page. An Early Bird seat gives that account 36 months of subscription at no charge, counted from the day paid subscriptions are introduced; during those months the account has full subscription access without payment. Early Bird months add to any referral credits (section 11). One seat per person: the seat is tied to the account it was assigned to, has no cash value, and cannot be transferred, sold, or exchanged. Deleting the account forfeits the seat, and seats are not reassigned. Seats may be withheld or removed in cases of abuse, fraud, or fictitious accounts. After the free months, the price, renewal and notice rules in this section apply, and no charge is made without your express acceptance of the pricing and terms in effect at that time. The offer closes once the seats are assigned and does not oblige us to introduce paid subscriptions by any date.
Continued use of paid features will require acceptance of the pricing and terms in effect at that time. Early Bird months and referral credits earned before that date apply as described in this section and in section 11.
11. Referral programme
You may invite colleagues using the personal link shown on the Invite page. An invitation is attributed when a new account signs up through your link (or through the sign-in email carrying your code) within a short window after the account is created; each new account can be attributed to at most one inviter, and self-referrals are void. Rewards are service credits (free months) recorded before paid plans launch and redeemable when they do; they add to any Early Bird months (section 10), and the credit amounts shown in the app may be adjusted before pricing activates. Credits have no cash value, are non-transferable, and may be withheld or removed in cases of abuse, fraud, or fictitious accounts.
12. Termination
You can stop using PaceTracker and delete your account at any time from the Account page; deletion is immediate and permanent. We may suspend or terminate accounts that violate these terms, with notice where reasonable.
13. Disclaimer of warranties
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent permitted by law.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or professional standing, arising from use of the service. Our total liability for any claim is limited to the amount you paid us for the service in the twelve months preceding the claim (or CAD $50 if you have paid nothing).
15. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Courts located in Alberta have exclusive jurisdiction.
16. Changes to these terms
We may update these terms; the date above reflects the latest version. For material changes we will notify you in the app or by email before they take effect.
